These Terms of Service apply to your use of baloira.com (the "Site") and any purchase from Baloira, a store operated by Yusuf Agir LLC ("Baloira", "we", "us"). By using the Site or placing an order, you agree to these Terms.

1. Eligibility

You must be 18 or older, or the age of majority where you live, to make a purchase. Information you provide must be accurate. The Site serves customers in Australia.

2. Products and descriptions

We aim for accurate listings, but colours may vary by screen and minor differences in size, finish or packaging can occur. Props shown in photos are generally not included. Please check measurements before ordering.

3. Lighting installation and safe use

Follow all included safety instructions. Hardwired fixtures must be installed by a licensed electrician in line with Australian wiring rules. Use recommended bulbs and wattage, and use outdoor-rated products only outdoors. Baloira is not responsible for damage or injury caused by improper installation, misuse or modification.

4. Pricing and availability

Prices are in Australian dollars (AUD) and may change without notice. Quantities may be limited and products may be discontinued. If an item you ordered becomes unavailable, you will receive a full refund for that item.

5. Orders

Your order is an offer to buy, which is accepted when we confirm it by email. We may refuse or cancel an order for reasons such as unavailability, pricing or description errors, or suspected fraud, with a full refund if payment has been taken. You may cancel your own order within 1 hour of placing it.

6. Payment

Payment is due at checkout. See our Transaction Policy for payment methods, taxes and security.

7. Shipping and delivery

We ship to Australian addresses only. Delivery times are estimates, not guarantees. Risk of loss passes to you on delivery. See our Shipping Policy.

8. Returns and refunds

Returns, refunds and cancellations are governed by our Return & Refund Policy, which forms part of these Terms.

9. Your account

You are responsible for keeping your login details secure and for activity under your account. Please tell us promptly about any unauthorised use.

10. Reviews and communications

Content you submit must be your own, accurate and lawful. You grant Baloira a non-exclusive, royalty-free licence to use it in connection with the store. We may remove content at our discretion.

11. Acceptable use

You may not use the Site unlawfully, interfere with it, upload harmful code, collect other users' data, or copy, scrape or resell our content or products without written permission.

12. Intellectual property

Site content belongs to Baloira or its licensors and is protected by law. Other brand names belong to their respective owners.

13. Third-party links and services

We are not responsible for third-party websites or services, such as payment providers or carriers. Your use of them is at your own risk.

14. Privacy

Your use of the Site is also governed by our Privacy Policy.

15. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

16. Disclaimer of warranties

Except as stated in these Terms or required by law, the Site and products are provided "as is" without warranties. We do not guarantee that the Site will always be available or error-free.

17. Limitation of liability

To the extent permitted by law, Baloira is not liable for indirect or consequential loss, or loss of profits, data or goodwill. Our liability for any order is limited to the amount you paid for that order.

18. Indemnification

You agree to cover claims, losses and reasonable legal costs arising from your breach of these Terms or misuse of the Site or products.

19. Governing law and disputes

Please contact us first so we can try to resolve any concern informally. These Terms are governed by the laws of Massachusetts, United States, without limiting any rights you have under the Australian Consumer Law or other laws of your place of residence that cannot be excluded.

20. Changes to these Terms

We may update these Terms. Changes take effect when posted on this page with a new "Last updated" date, and continued use of the Site means you accept them.

21. Severability

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect.
